Required Notification

I. POLICY

An agent who makes an arrest or takes law enforcement action under this law is required to notify the Chief/Agency Head of the law enforcement agency having local jurisdiction. The law also requires notification to the Commander of the nearest Maryland State Police Barrack (or his/her designee) unless there is an agreement otherwise.

If participating in a joint investigation as described in Index Code 2101 - Statewide Law Enforcement Authority, Section III.A, the notification must be made in advance and as directed by the agent’s supervisor. In all other cases, it must be made as soon as practical.

II. PROCEDURES

To make the required notification, agents are to contact the local law enforcement agency and advise them of the circumstances surrounding any law enforcement actions taken. Notification can be made by police radio or by telephone. Agents may also attempt to locate a local law enforcement officer or MSP trooper to make notification and/or request assistance. Agents will document in a police report that the required notification has been made to the appropriate law enforcement officials.
