Subject: Statewide Caterer’s License (SCAT License)
The State Comptroller is authorized to issue a Statewide Caterer’s License to sell alcoholic beverages at catered events under authority of section 6-701, of Article 2B, of the Annotated Code of Maryland. That original legislation took effect October 1, 1998. In addition, COMAR regulation 03.02.01.18, re. Statewide Caterer’s License, was adopted and took effect October 5, 1998, to set forth certain requirements of the license holder.
The purpose of this administrative release is to clarify the authority of the license and to reiterate the reporting requirements of the license.
- The SCAT license can only operate when there is a contractual arrangement between the SCAT licensee and another party to cater alcoholic beverages at an event. A SCAT licensee is not authorized to hold an event on their own where alcoholic beverages are to be dispensed.
- The SCAT licensee is required to complete the Catered Event Certificate and Notice. The original is to be maintained by the SCAT licensee as a record of the event, a copy is to be posted at the catered event, and the third copy is to be filed with the respective local county liquor board at least 5 days prior to holding a catered event.
- The SCAT licensee is authorized to sell alcoholic beverages at a cash bar or otherwise, as the contract describes.
- A one-day license issued by the local county liquor board, is required if the event holder desires to sell tickets to an event whereby the sale of alcoholic beverages is included in the price of a ticket. A one-day license can only be issued to an entity who qualifies as a non-profit organization.
- Hours of operation for a SCAT license shall be the same as those of a holder of a class B restaurant license issued by the respective local county liquor board.
Statewide Caterer’s license holders will be held accountable to operate within the scope of their license authority.
